2. Purpose

These Terms of Use (the “Terms”) govern the use of the MoveKind mobile application (the “Application”), available on iOS through Apple’s App Store.

MoveKind is a fitness application offering guided workout sessions through an AI-powered virtual coach (Maya or Leo). The Application allows users to follow structured training paths, run quick sessions, and track progress.

By downloading, installing, or using the Application, the user fully accepts these Terms.

3. Access and Conditions of Use

3.1 Minimum Age

The Application is intended for users aged 16 years or older. By using the Application, the user confirms they are at least 16 years old. If the user is a minor (between 16 and 18), they confirm they have obtained permission from their legal guardian.

3.2 User Account

The Application does not require account creation. User data is stored locally on the device. No username, password, or email address is required to use the Application.

3.3 Availability

The Application is currently available on iOS (iPhone). Eaglets makes reasonable efforts to keep the Application available at all times but does not guarantee uninterrupted availability. Interruptions for maintenance, updates, or technical reasons may occur without prior notice.

5. Subscription and Payment

5.1 Pricing

MoveKind Premium subscriptions are offered at:

Prices are shown in euros, tax included. Prices in other currencies are set by Apple based on App Store pricing tiers for each country.

5.2 Payment

Payment is processed exclusively through Apple’s In-App Purchase system. The amount is charged to the user’s Apple ID account upon purchase confirmation.

Eaglets does not collect or store payment details (card number, bank information). All transactions are handled by Apple.

5.3 Free Trial

The yearly plan includes a 7-day free trial. The trial is available once per user and Apple ID account. At the end of the trial, the subscription renews automatically at the current rate unless canceled at least 24 hours before the trial ends.

5.4 Auto-Renewal

The subscription renews automatically at the end of each billing cycle (monthly or yearly), unless canceled by the user at least 24 hours before renewal.

5.5 Cancellation

Users can cancel at any time from iPhone settings:
Settings > Apple ID > Subscriptions > MoveKind Premium > Cancel

Cancellation becomes effective at the end of the current period. Users keep premium access until the end of the paid period.

5.6 Refunds

In accordance with Apple’s terms, refund requests must be made directly to Apple via:

Eaglets does not issue direct refunds because transactions are fully managed by Apple.

5.7 Restore Purchases

Users can restore purchases after reinstalling the Application or changing devices via the “Restore purchases” button available on the subscription screen.

6. Referral Program

6.1 How It Works

MoveKind includes a referral program that allows users to invite friends. When a referred friend signs up with the referrer’s code and completes a first workout, both users receive 7 days of premium access.

6.2 Limits

Each user can make up to 5 referrals. Premium days earned through referrals can be combined with an active subscription (added at the end of the current paid period).

6.3 Abuse

Eaglets reserves the right to suspend or cancel referral benefits in case of abuse, including fake account creation or automated behavior.

7. Health Disclaimer

7.1 No Medical Advice

The Application does not provide medical advice. Sessions are general exercise programs. Maya and Leo are AI-powered virtual personas and do not replace advice from a healthcare professional.

7.2 Medical Recommendation

Users are advised to consult a physician before starting any exercise program, especially in case of pre-existing medical conditions, pregnancy, or return to activity after prolonged inactivity.

7.3 Use at Your Own Risk

Users perform exercises at their own risk. Eaglets cannot be held liable for physical injury resulting from use of the Application.

7.4 Calorie Estimates

Calorie data shown in the Application are estimates based on duration and workout intensity. They are not medical or health data under applicable regulations.

8. Intellectual Property

8.1 Ownership

All Application components (source code, design, illustrations, animations, text, logo, the “MoveKind” name, Maya and Leo characters, sounds) are the exclusive property of Eaglets or licensed to Eaglets.

8.2 License to Use

Eaglets grants users a personal, non-exclusive, non-transferable, revocable license to use the Application for strictly personal, non-commercial purposes.

11. Liability

11.1 Limitation of Liability

The Application is provided “as is”. Eaglets makes reasonable efforts to ensure reliability but does not guarantee absence of bugs, interruptions, or errors.

Eaglets shall not be liable for failure to perform obligations due to force majeure events.

12. Changes to the Terms

Eaglets reserves the right to modify these Terms at any time. Changes take effect upon publication in the Application or on movekind.io. Continued use of the Application after such changes constitutes acceptance of the updated Terms.

In case of substantial changes, users will be informed through an in-app notice.

13. Termination

Eaglets reserves the right to suspend or terminate access to the Application in case of violation of these Terms, without prejudice to any claim for damages.

Users may stop using the Application at any time by deleting it from their device.

14. Governing Law and Jurisdiction

These Terms are governed by French law.

In case of dispute regarding interpretation or performance of these Terms, the parties will first attempt an amicable resolution. Failing that, the competent courts of Nanterre (France) shall have exclusive jurisdiction.
